Dynasty Trusts

A dynasty trust is a long-term irrevocable trust designed to preserve and manage wealth for multiple generations. Rather than distributing assets outright to children or grandchildren, a dynasty trust can hold and administer property for descendants over an extended period, subject to applicable state law.

The primary purpose of a dynasty trust is to combine wealth transfer, asset protection, tax planning, and family governance. Assets transferred to the trust may remain protected from beneficiaries’ personal creditors, divorcing spouses, poor financial decisions, and unnecessary dissipation. The trust can provide access to resources without giving beneficiaries direct ownership.

Dynasty trusts are often paired with generation-skipping transfer tax planning. When properly structured and funded with available exemptions, trust assets and future appreciation may benefit multiple generations without being subject to estate tax at each generational level.

The trustee plays a central role. A dynasty trust may use an individual trustee, corporate trustee, trust company, or a combination of fiduciaries. Some trusts include distribution advisors, investment advisors, or trust protectors to provide additional flexibility and oversight.

Distribution standards can be tailored to family goals. The trust may authorize distributions for health, education, maintenance, support, business opportunities, home purchases, philanthropy, or other purposes. Some families use dynasty trusts to encourage education, entrepreneurship, stewardship, and responsible wealth management.

Dynasty trusts can also hold business interests, family investment entities, farmland, real estate, or marketable securities. When combined with family LLCs or partnership structures, they can support centralized management and long-term ownership continuity.

State law matters. Rules governing trust duration, creditor protection, taxation, and administration vary significantly. Families with substantial wealth may consider situs selection as part of the planning process.

A dynasty trust should not be viewed merely as a tax tool. It is also a family governance instrument. It can preserve values, provide structure, reduce conflict, and ensure that inherited wealth is managed with purpose.

For families seeking to create enduring wealth structures, a dynasty trust can serve as a private framework for stewardship across generations. It requires thoughtful drafting, careful trustee selection, and ongoing administration.
